SportswearForYou is not responsible for User Content. Except for the license you grant us below, as between you and SportswearForYou, you retain all rights in and to your User Content, excluding any portion of The Platform included in your User Content.  All Submissions shall automatically become the sole and exclusive property of SportswearForYou and shall not be returned to you.You warrant that your Submissions, in whole or in part, are clear and free of any intellectual property right infringement, disputes or third-party claims. In addition to the rights applicable to any Submission, when you post comments or reviews to the Platform, you also grant SportswearForYou the right to use the name that you submit with any review, comment, or other content, if any, in connection with such review, comment, or other content. You represent and warrant that you own or otherwise control all of the rights to the reviews, comments, and other content that you post on this Platform and that use of your reviews, comments, or other content by SportswearForYou will not infringe upon or violate the rights of any third party. You shall not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead SportswearForYou or third parties to obtain unjust enrichment. License to Use

You grant SportswearForYou and its subsidiaries and affiliates a non-exclusive, perpetual, irrevocable, transferable, sub-licensable, royalty-free, worldwide and fully paid license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly or otherwise perform and display, and exploit your User Content, including the likeness of any person that appears in the User Content and any of the concepts or ideas contained in the User Content, for any purpose, including commercial uses, in all media formats and channels now known or later developed without compensation to you or any third party.

You represent and warrant that your User Content, and our use of such User Content as permitted by these Terms, will not violate any rights of any person or entity, including any third-party rights, or cause injury to any person or entity. SportswearForYou assumes no liability for any misuse of copyright or any other rights of third parties by you. You undertake to defend for and indemnify SportswearForYou against any losses caused due to your misbehavior regarding the commentaries and remarks for any purposes. 

4. Orders and Purchases

Pricing

Product prices on the website are in U.S. dollars. If your local currency is not US dollars, your bank or credit card issuer will apply the exchange rate and any fees in accordance with the bank/issuer’s terms and regulations that apply to you and your credit or debit card. The exchange rate and any fees charged by the bank/issuer are beyond our control. 

Prices displayed at checkout may include the main price, coupons, shipping cost (based on destination), and other taxes per local rules. However, you are responsible for additional VAT, customs duties, or fees in your country. Prices are real-time and may change due to market fluctuations, promotions, or inventory, but they are fixed upon order confirmation.

Typographical Errors

While we aim for accuracy, pricing or product errors may occur. We cannot confirm a price until your order is accepted. If an item is listed incorrectly due to an error in pricing or product information, SportswearForYou shall have the right to refuse or cancel any orders placed for that item. • Your order has been flagged by our security systems as potentially fraudulent or was placed using automated ordering software or technology.

• There is evidence that you are not eligible to purchase or if the item you wish to order or purchase contains a misspelling, mispricing, or other mistake or error.

SportswearForYou will decide at its sole discretion whether any of the above events occur. We will notify you if all or any portion of your order is canceled or if additional information is required to accept your order.

Colors and Packing

Product colors are displayed as accurately as possible, but actual colors depend on your monitor—we cannot guarantee exact matches. Packing meets minimum standards for the selected shipping method. You are responsible for costs of any special packing, loading, or bracing requested.

Payments

Accepted payment methods include Visa, Mastercard, American Express, Union Pay,Google Pay, Apple Pay, and online banking. All transactions are debited at purchase. To prevent unauthorized access, card details are encrypted, and we request pre-authorization for sufficient funds. We do not store financial information; your card issuer retains it. By clicking “Pay Now,” you confirm the card is yours and authorize the payment. If authorization fails, we are not liable for delays or failure to deliver and we will be unable to conclude any transaction.

5. Shipping and Return

Shipping and Delivery

When an order is placed, it will be shipped to an address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on this Platform and we may use third-party logistics . Orders with multiple items may be split into packages at our discretion. You can Track orders through the tracking link email sent by us. If the carrier’s tracking link for your order doesn’t show any activity or movement for more than 5 business days, please reach out to Customer Service for further investigation.Delivery times vary, especially during peak periods. Shipping time is generally 15-25 working days and can vary based on situations and availability of carriers(excluding some public holidays). Please check in time after delivery. Title and Risk of Loss

Title and possession rights remain with SportswearForYou until full payment, including any deferred amounts, interest, or charges. The risk of loss or damage shall be transferred to at the time that the goods are delivered from the first carrier. Any claim from you relative to damage generated in the middle of shipping or delivery should be made directly to the carrier. Claims against us for pre-delivery damage or wrong order, must be made within 3 days of receipt. You agree to assist in maintaining our title rights.

Replacement / Refund Of Products

Products can be requested to be replaced or refunded in the designated period of 3 days within delivery if there is a reasonable cause. The exact replacement / refund period differ from country to country. For more details please refer to our Return, Replacement or Refund Policy.

Sportswearforyou Makes No Presentations Or Warranties Of Any Kind, Express Or Implied, As To The Operation Of The Site Or The Information, Content, Materials, Or Products Included On This Site Except As Provided Here To The Full Extent Permissible By Applicable Law, Sportswearforyou Disclaims All Warranties, Express Or Implied, Including, But Not Limited To, Implied Warranties Of Merchantability And Fitness For A Particular Purpose, Noninfringement, Title, Quiet Enjoyment, Data Accuracy, And System Integration. To The Maximum Extent Permitted By Applicable Law, Sportswearforyou’s Total Liability To You For Any Damages (Regardless Of The Foundation For The Action) Shall Not Exceed In The Aggregate The Amount Of Fees Actually Paid By You Through Sportswearforyou During The Month Immediately Preceding The Act Allegedly Giving Rise To Sportswearforyou’s Liability.

8. Force Majeure

We are not liable for delays or failures due to events beyond our control (“Force Majeure”), such as fire, explosion, natural disasters, wars, strikes, pandemics, governmental actions, supply chain issues, or system failures. Our obligations under these General Conditions will be suspended and the time for the performance of our obligations will be suspended for the time required to resolve the event beyond our control

9. Assignment

Our prior written consent is required before any assignment or transfer of the Terms regardless of the rights or obligations. Otherwise, the attempted assignment or transfer is void. You acknowledge that you permit us to freely assign or transfer this Terms which ensures to the benefit of and is binding upon the parties and the employees, contractors, successors, trustees or respective legal representative.

10. Termination 

In addition to any other legal or equitable remedies, SportswearForYou may or may not send prior 2-day notice to you before terminating the Terms or revoke any or all of your rights, benefits or any other interests granted under thisTerms at the time of breach of this Terms .. Upon termination , you shall immediately cease all access to and use of this Platform , in addition to any other legal or equitable remedies, immediately revoke all password(s), and account identification issued to you and deny your access to and use of this Platform in whole or in part. Any termination of this Terms shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. However,  the products before proceeding to place an order shall be halted because of the unnecessary and complicated refund and return procedures.

11. Dispute Resolution

Informal Resolution

For any claim, dispute, or controversy (“Claim”) between you and SportswearForYou or any of its subsidiaries, affiliated companies, employees, agents, officers, directors, shareholders, and/or licensors (which shall be third party beneficiaries of this arbitration provision), we agree to attempt informal resolution (e.g., negotiation) first. If we cannot resolve the Claim informally within thirty (30) days, you and SportswearForYou agree to resolve all Claims exclusively through final and binding arbitration, rather than in court, as, and except as, providing below. 

Binding Arbitration

In the event that informal efforts to resolve disputes are unsuccessful, any Claims between you and SportswearForYou operated under FAR SportsWear LLC arising out of or related to this Terms shall be submitted to the Bangladesh International Arbitration Centre (“BIAC”) for arbitration which shall be conducted in accordance with the BIAC’s arbitration rules in effect at the time of applying for arbitration. The arbitration clause shall be governed by the lex arbitri. The seat of arbitration shall be Dhaka. The arbitration proceedings shall be conducted in English or Bangla. The arbitral awards are final and binding upon both parties.

Venue For Any Judicial Proceeding

The proper venue for any judicial action arising out of, relating to, or in connection with these Terms will be the courts located in or nearest to Bangladesh. The parties stipulate to, and agree to waive any objection to, the personal jurisdiction and venue of such courts, and further expressly submit to extraterritorial service of process.

 

12. Applicable Laws

These Terms shall be governed by and construed under the laws of the United States of America (“U.S.A.”) without regard to conflict of law provisions.

13 Miscellaneous

 Waiver

No waiver by us of any of these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing. Any failure  to enforce any provision of this Terms will not be considered a waiver of our right to enforce such provision. The obligations of the parties under this Terms that by their nature would continue beyond expiration or termination of this Terms shall survive any such expiration or termination.

Severability

If any of these Terms  or any provisions are determined to be invalid or unenforceable to any extent, such invalidity or unenforceability will attach only to such provision or part thereof and the remaining part of such provision and all other provisions hereof will continue in full force and effect.

Electronic Communications

By using the Platform, you agree to receive certain electronic communications from us, subject to applicable law. Communications and transactions between SportswearForYou and you may be conducted electronically.

14. Entire Agreement

These Terms, including linked policies (e.g., Privacy Policy), constitute the entire agreement between you and us. This Agreement supersedes any prior proposal or agreement (oral or written).
